Khan was charged under Section 223 of the Bharatiya Nyaya Sanhita (BNS) for ignoring directives from public officials and Section 126 of the Representation of the People Act, 1951.

On the same day, Chief Minister Atishi was also booked for breaching the MCC, in addition to another incident where her supporters were accused of hindering governmental operations and assaulting a police officer.
Following her booking, CM Atishi, the AAP candidate for the Kalkaji seat, criticized the Delhi Police and the Election Commission of India (ECI) for allegedly behaving in a biased manner.
In a message on social media platform X, she claimed her rival, Ramesh Bidhuri, and his family were openly violating the MCC without facing any repercussions.
Atishi remarked on Chief Election Commissioner Rajiv Kumar: "The Election Commission is also amazing! Ramesh Bidhuri ji's family members are openly violating the Model Code of Conduct. No action is being taken against them."
In response, Bidhuri stated that Atishi was panicking over the prospect of defeat and advised her to maintain the dignity of her position.
Additionally, Ramesh Bidhuri's nephew, Manish Bidhuri, has been charged under the Representation of People Act.
The voting process for the 70-member Delhi Assembly is currently ongoing, with results scheduled for release on February 8.
