New Delhi, Feb 21 (NationPress) The Supreme Court Collegium, led by Chief Justice of India (CJI) Sanjiv Khanna, has given the green light for the appointment of five advocates as judges of the Patna High Court.

The Supreme Court Collegium convened on 20th February 2025, and approved the following advocates for the position of judges at the High Court of Judicature at Patna: (i) Shri Alok Kumar Sinha, (ii) Shri Ritesh Kumar, (iii) Smt. Soni Shrivastava, (iv) Shri Sourendra Pandey, and (v) Shri Ansul @ Anshul Raj, as stated in a release on the apex court's official website.

According to the memorandum of procedure (MoP) that governs the appointment of High Court judges, the proposal must be initiated by the Chief Justice.

If the Chief Minister wishes to suggest a name, it is required to be forwarded to the Chief Justice for consideration.

The Governor, acting on the advice of the Chief Minister, is responsible for sending his recommendation, along with the full set of documents, to the Union Minister of Law & Justice within six weeks of receiving the proposal from the Chief Justice of the High Court.

If feedback is not provided within this timeframe, the Union Minister of Law & Justice may assume that the Governor (or Chief Minister) has no further input and will proceed accordingly.

The Union Minister of Law & Justice will evaluate the recommendations based on any additional reports available regarding the candidates being considered. The complete documentation will then be sent to the Chief Justice of India for his input.

The Chief Justice of India, in consultation with the two most senior judges of the Supreme Court, will formulate his opinion about the recommended candidates for appointment to the High Court. Following their discussions, the Chief Justice of India will submit his recommendation to the Union Minister of Law & Justice within four weeks.

Furthermore, as per the MoP, once the appointment warrant is signed by the President, the Secretary of the Department of Justice will notify the Chief Justice, and a copy of this communication will be sent to the Chief Minister. The Chief Minister will also be responsible for announcing the appointment and publishing the necessary notification in the Gazette of India.
